You will be given a download link to download the leads at your convenience. There will be no refunds for server memberships or database purchases, all sales are final. Any changes to this Service Agreement must be in writing with signatures of both parties.
This Service Agreement constitutes a legal and binding contract and is being executed by authorized personnel of both parties. No verbal understandings have any part of this agreement. We are not able to make guarantees on the data/leads we offer as we are media buyers, not lead generators, however, we do maintain a strict relationship with these networks to maintain quality.
We are authorized to sell this data by our sources. You agree that you will not take any legal action against us for any reason. We may disclose our source if a major lawsuit is going to be filed against you due to negligence by one of our sources, however, you agree not to take any legal action against us.
Data Management & Publishers:
Indemnification. Publisher/List Owner is solely responsible
for any and all legal liability arising out of or relating
to email marketing or the list managed. Publisher/List Owner
hereby agrees to indemnify, defend and hold harmless Deal
Direct LLC and its officers, directors, agents, affiliates,
Advertisers and employees from and against all claims,
actions, damages, liabilities, losses, costs and expenses
(including reasonable attorneys' fees and the cost of
indemnifying third parties) arising out of or related to:
(a) libel, defamation, violation of right of privacy or
publicity, breach of contract, copyright infringement,
trademark infringement or other infringement of any third
party right, fraud, false advertising, misrepresentation,
product liability or violation of any law, statute,
ordinance, rule or regulation throughout the world in
connection with Publisher Content; (b) any breach by
Publisher/List Owner of any duty, representation or warranty
under this Agreement, including but not limited to breach of
any of Publisher's/List Owner's Responsibilities (c) a
contaminated file, virus, worm, or Trojan horse originating
from the Publisher/List Owner Content (other than through an
Ad); and, (d) the acts and/or omissions of any
Sub-Publishers/List Owners. Publisher/List Owner agrees and
acknowledges that it shall be fully responsible for any and
all taxes, whether state or local, and related fees, costs
and penalties incurred by Company and/or any of its
Advertisers. |
